Spousal Support
Also known as alimony, spousal support involves the payment of financial support from one spouse to another following separation or divorce. Alimony may be awarded to either spouse in an effort to maintain the standard of living both parties were accustomed to during the marriage. The following factors may be considered when determining alimony payments: duration of the marriage, earning capacity of both parties, age, as well as physical, mental and emotional state of each party, other income, the ability of the supporting spouse to pay support, and the contribution of one spouse as a homemaker. The duration of spousal support is within the discretion of the Court.
Some divorcing couples will not need alimony and will not request that payments be made.
